By accessing or using the Huddel platform ("Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all terms and conditions, you may not access or use the Platform. These Terms apply to all visitors, users, and others who access or use the Platform.
Huddel is a goal-setting and achievement platform that allows users to create goals, set milestones, invite supporters, and track progress. The Platform facilitates accountability and motivation through a network of supporters who can provide encouragement and rewards for milestone achievements.
Age Requirements: You must be at least 13 years old to use the Platform. If you are under 18, you must have parental or guardian consent to use the Platform and agree to these Terms.
Account Information: You must provide accurate, current, and complete information during registration and keep your account information updated. You are responsible for safeguarding your password and all activities that occur under your account.
One Account Per Person: You may only maintain one active account. Creating multiple accounts to circumvent restrictions or duplicate usage is prohibited.
Legal Compliance: You must comply with all applicable local, state, national, and international laws and regulations when using the Platform.

Subscription Plans: The Platform offers both free and paid subscription plans. Paid plans provide additional features and functionality as described on our pricing page.
Billing and Payments: Subscription fees are billed in advance on a monthly or annual basis. Payment is due immediately upon subscription activation. We accept payment methods as specified during the subscription process.
Auto-Renewal: Subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date. You authorise us to charge your payment method for renewal fees.
Free Trials: We may offer free trial periods for paid subscriptions. If you do not cancel before the trial ends, you will be charged for the subscription. Free trial eligibility may be limited and is subject to our discretion.
Fee Changes: We reserve the right to change subscription fees with 30 days' advance notice via email to your registered address and prominent platform notification. Continued use of the Platform after fee changes constitutes acceptance of the new fees.
Failed Payments: If payment fails, we may suspend or terminate your subscription. You remain responsible for any unpaid fees. We may retry failed payments and charge applicable fees.
Cooling-Off Period: In addition to our standard refund policy, Australian consumers may have cooling-off rights under consumer protection laws in their state or territory.
Refunds: Refunds are governed by our Refund Policy, which is incorporated into these Terms by reference.
Your Content: You retain ownership of all content you create, upload, or share through the Service, including goals, progress updates, messages, and other materials ("User Content").
License to Huddel: By using the Platform, you grant Huddel a worldwide, non-exclusive, royalty-free, transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform your User Content solely for the purpose of providing and improving the Platform.
Content Responsibility: You are solely responsible for your User Content and the consequences of posting or publishing it. You represent and warrant that you own or have the necessary rights to all User Content you submit.
Prohibited Content: You may not upload, post, or share content that:
Content Removal: We reserve the right to remove or disable access to any User Content that violates these Terms or is otherwise objectionable, without prior notice.
Huddel's Intellectual Property: The Platform and its original content, features, and functionality are owned by Huddel and are protected by international copyright, trademark, and other intellectual property laws.
Reporting Copyright Infringement: If you believe that content on our platform infringes your copyright, please contact us at hello@huddel.app with the following information:
Takedown Process: We will investigate valid copyright infringement claims and may remove content that appears to infringe copyright. We may also suspend or terminate accounts of repeat infringers.
Counter-Notice: If you believe your content was wrongly removed, you may submit a counter-notice to hello@huddel.app explaining why you believe the content does not infringe copyright.
Supporter Roles: Supporters are individuals you invite to follow your goal progress and provide encouragement or rewards. Supporter relationships are voluntary and can be modified or terminated at any time.
Supporter Eligibility: Supporters must be at least 13 years old. We reserve the right to verify the identity and age of supporters and may request additional information to ensure platform safety.
Platform Guidelines for Supporters:
Dispute Resolution: While we provide the platform for supporter relationships, we are not responsible for disputes between users and supporters. We reserve the right to intervene in cases of clear policy violations or abusive behaviour.
Reward Fulfilment: Huddel does not guarantee that supporters will fulfil promised rewards. Reward agreements are between individual users and their supporters. Users should exercise due diligence when accepting rewards from supporters.
Reward Transaction Disclaimer: We are not responsible for any disputes, fraud, or issues arising from reward transactions between users and supporters. Users enter into reward agreements at their own risk and should verify the legitimacy and appropriateness of any rewards offered.
Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your information when you use the Platform. By using the Platform, you consent to the collection and use of information as outlined in our Privacy Policy.
Service Availability: The Platform is provided "as is" and "as available" without warranties of any kind, except as required by law. We do not guarantee that the Platform will be uninterrupted, secure, or error-free.
Warranties: To the extent permitted by law, we disclaim all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. However, nothing in these Terms excludes warranties or conditions that cannot be excluded under the Australian Consumer Law.
Limitation of Liability: To the maximum extent permitted by law, Huddel's liability for any breach of a consumer guarantee under the Australian Consumer Law is limited to, at our option: (a) re-supplying the services, or (b) paying the cost of having the services re-supplied.
Excluded Liability: To the extent permitted by law, Huddel shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or other intangible losses, resulting from your use of the Platform.
Maximum Liability: Subject to the Australian Consumer Law, our total liability to you for any claims arising from these Terms or your use of the Platform shall not exceed the amount you paid to us in the 12 months preceding the claim.
External Relationships: We are not responsible for any disputes, damages, or issues arising from relationships between users and their supporters, including unfulfilled rewards or interpersonal conflicts.
Termination by You: You may terminate your account at any time by contacting us at hello@huddel.app or through your account settings. Upon termination, your right to use the Platform will cease immediately.
Termination by Us: We may terminate or suspend your account immediately, without prior notice, if you breach these Terms or engage in conduct that we determine is harmful to the Platform or other users.
Effect of Termination: Upon termination:
Data Retention: Following account termination, we may retain certain information as described in our Privacy Policy and as required by law.
Governing Law: These Terms are governed by and construed in accordance with the laws of Queensland, Australia.
Dispute Resolution: Any dispute arising from these Terms or your use of the Platform will first be subject to good faith negotiations between the parties. If negotiations fail, disputes may be resolved through mediation with the Australian Commercial Disputes Centre (ACDC) or the courts of Queensland, Australia.
Jurisdiction: You agree to submit to the exclusive jurisdiction of the courts of Queensland, Australia for any legal proceedings.
Consumer Law: Nothing in these Terms excludes, restricts, or modifies any consumer guarantees, warranties, or other rights under the Australian Consumer Law or other applicable consumer protection laws that cannot be excluded, restricted, or modified by agreement.
Entire Agreement: These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and Huddel regarding the Platform.
Modifications: We reserve the right to modify these Terms at any time. We will notify users of material changes via email or through the Platform. Continued use after modifications constitutes acceptance of the updated Terms.
Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
No Waiver: Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.
Assignment: You may not assign or transfer these Terms or your rights hereunder without our written consent. We may assign these Terms without restriction.
Force Majeure: We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, government actions, pandemics, cyber attacks, internet outages, and third-party service failures.
